Use of Service

• You must be at least 18 years old to use the Service
• You are responsible for all activity under your account
• You agree to use the Service only for lawful purposes

Subscription Changes and Usage-Based Charges

Our Service may include subscription plans with usage limits, credits, or minimum balance requirements. By using the Service, you acknowledge and agree to the following:

• Certain plans may operate on a usage-based or credit-based model, where charges are applied when your usage reaches a defined threshold or minimum balance.
• If your account balance, credits, or usage allowance reaches the minimum threshold, we may automatically charge your selected payment method to continue uninterrupted service.
• You authorize us to automatically deduct applicable charges based on your usage, selected plan, or applicable overage rates.
• Charges incurred due to usage beyond your plan limits are non-refundable.
• We may modify pricing, minimum balance thresholds, or charging mechanisms with reasonable prior notice through the Service or via email.

If automatic payment fails or a minimum balance is not maintained, we reserve the right to suspend or limit access to the Service until payment is successfully completed.

Fees and Payments

By subscribing, you agree to pay all applicable fees associated with your selected plan.

• All fees are billed in advance and are non-refundable unless required by law
• Failure to complete payment may result in suspension or termination
• Taxes, duties, or government charges are your responsibility

User Content

You retain ownership of content you upload or submit. You grant us a limited, non-exclusive license to process this content solely to provide and improve the Service.

Prohibited and Restricted Uses

You agree not to use the Service for any unlawful, harmful, or unethical purposes. The following uses are strictly prohibited:

• Using the Service for websites or businesses that promote or sell illegal drugs, narcotics, or controlled substances
• Promoting use of alcohol, tobacco, vaping, or similar substances
• Generating, promoting, or distributing content that encourages violence, self-harm, terrorism, or criminal activity
• Creating deceptive, misleading, or fraudulent business websites or chatbot experiences
• Using the Service to provide medical, legal, or financial advice without appropriate disclaimers or required licenses
• Uploading content that is abusive, hateful, sexually explicit, or harmful to minors
• Using the Service in violation of any applicable local, national, or international laws or regulations

We reserve the right to suspend or terminate access to the Service if we determine, at our sole discretion, that the Service is being used in violation of these restrictions.

Service Availability

We are committed to providing a reliable and continuously improving service. Our platform is designed to be available on a 24/7 basis; however, availability may occasionally be affected by maintenance, updates, infrastructure issues, or circumstances beyond our reasonable control.

We may perform scheduled maintenance or upgrades to enhance performance, security, or functionality. When reasonably possible, we will provide advance notice of such maintenance through the Service or via email.

Temporary interruptions or limitations in access do not constitute a breach of these Terms. We continuously monitor and optimize the Service to minimize disruptions and restore access as quickly as possible.

The Service is provided through our web application accessible at app.cloudifychat.com.

Limitation of Liability

To the maximum extent permitted by law, Cloudify Chat shall not be liable for any indirect, incidental, special, consequential, or loss-of-profit damages arising from your use of the Service.

The Service is provided on an "as is" and "as available" basis. We make no warranties regarding accuracy, reliability, or suitability of chatbot responses for any purpose.

Termination

We may suspend or terminate your account if you violate these Terms or misuse the Service. Upon termination, your right to use the Service will immediately cease.
